An interesting article in Newsday.com reads that womens groups who once applauded no fault divorce are not rethinking its impact on women.
California where I practice, as most people know is a no fault state. That means that a couple can get divorced for any reason, the most common being irreconcileable differences. With that being said, the reason has no effect on the other issues of the case, as they were prior to no fault divorce.
The article goes on to say that, the previous fault system allowed women to negotiate better divorce settlements, whereas the no fault system was designed to speed up divorce and lower the cost of a divorce.
I have never practiced in a fault system so I am unsure how it would affect a divorce battle. If it increased the anger, I would certainly opt to stay with the current system. Divorce can get messy without additional issues added to the mix.
